What To Do After A Car Accident In Las Vegas

The first hours after a crash shape both your recovery and your claim. What you do in that window can protect your health and preserve details that often get questioned later.

  • Get To Safety And Call 911. Move out of traffic if you can safely do so, then call the police. Nevada law requires drivers in an injury crash to stop and report it (NRS 484E), and the police report becomes the first official record of what happened.
  • Document The Scene And Exchange Information. Photograph the vehicles, the road, and your injuries. Collect names, license plates, and insurance details from everyone involved. If no officer responds, Nevada requires you to file an SR-1 report with the DMV within 10 days (Nevada DMV).
  • See A Doctor, Even If You Feel Fine. Crash injuries hide. Whiplash and concussion symptoms can surface a day or two later, and a gap in treatment is the first thing an adjuster uses to discount a claim, so get checked early.
  • Talk To A Lawyer Before You Talk To The Insurer. Under Nevada law, an adjuster may not advise you to skip hiring counsel (NRS 686A.310), yet many imply it anyway. One short call protects you.

Compensation You Can Recover After A Crash

Your claim includes emergency care, hospital treatment, surgery, rehabilitation, and ongoing medical needs. Nevada does not cap economic damages in car accident cases, so recovery is tied to actual cost.

You can recover income lost while you were unable to work, along with future losses if your injury affects your ability to earn the same way as before.

Nevada allows compensation for physical pain, emotional distress, and the loss of normal daily activities. These damages are not capped; they must be supported by evidence.

This includes vehicle repairs or replacement, rental costs, and diminished value after a crash.

In DUI or extreme recklessness cases, Nevada allows punitive damages under NRS 42.005, with additional rules under NRS 42.010.

Nevada’s modified comparative negligence rule (NRS 41.141) reduces your recovery by your percentage of fault and bars it completely at 51 percent.
